Petition to remove Kejriwal from CM post rejected twice Arvind Kejriwal did not resign from the post of Chief Minister after his arrest in March. He is running the government from jail. However, in the meantime, the matter of removing Kejriwal from the post of CM reached the court twice.

  • April 10 – From Delhi High Court: On April 10, the Delhi High Court dismissed the petition saying that this is an issue of the executive. ACJ Manmohan said, “We should not hear this petition. The executive should look into this matter. There is no scope for interference by the judiciary in this.”
  • 13 May – From the Supreme Court: The petition demanding the removal of Delhi Chief Minister Arvind Kejriwal from the post of CM has also been rejected by the Supreme Court. While hearing the case, Justice Khanna had said – We are not interfering with the decision of the High Court. If Delhi LG Vinay Kumar Saxena wants to take action in the case, he can do so.

Kejriwal got bail thrice and came out once. Kejriwal was arrested by ED on 21st March in the money laundering case related to Delhi liquor policy. Then CBI arrested him from Tihar jail on 26th June in a corruption case.

The Supreme Court granted interim bail to Kejriwal in the ED case on July 12, but he remains in jail in the corruption case. The Supreme Court has reserved its verdict on his petition challenging his arrest in the CBI case on September 5.

Atishi said – If President’s rule is imposed, BJP will get zero seats. Delhi government minister and AAP leader Atishi said, “BJP has only one job – to topple elected governments. Wherever BJP does not win, it tries to form government through the back door by buying MLAs. They could not topple the government by buying AAP MLAs. So now they have started another conspiracy.

Atishi further said- I want to tell BJP that the people of Delhi are watching everything. People know that if anyone works for them, it is Arvind Kejriwal.

Question- Tenure till February 2025, will the Kejriwal government be dismissed? Arvind Kejriwal is adamant on not resigning from the post of Chief Minister. Now if the Home Ministry takes some action on the letter of BJP MLAs and the government is dismissed, then President’s rule can be imposed. Anyway, assembly elections can be held in Delhi in the next four-five months. The tenure of the Delhi government is ending in February 2025.

The first President’s rule was imposed in Delhi during the Kejriwal government

  • President’s rule was imposed in Delhi for the first time on 15 February 2014. Then Arvind Kejriwal resigned 49 days after becoming the Chief Minister for the first time. Kejriwal had formed the government with the support of Congress.
  • After 363 days of President’s rule till 13 February 2015, Kejriwal again assumed power in Delhi on 14 February 2015. He won the elections with an absolute majority. The Aam Aadmi Party won 67 out of 70 seats in Delhi.
  • If the President agrees to the demand of the BJP MLAs, then this will be the second time when President’s rule is imposed in Delhi and the reason for this will also be Kejriwal and the Aam Aadmi Party.
