SC Quashes Expulsion of ex-Punjab CM Amarinder Singh from Assembly
Giving relief to former Punjab chief minister Amarinder Singh, a Constitution bench of the Supreme Court has repealed his expulsion from state Assembly for his alleged role in the Amritsar land allotment scam, said media reports.
A bench headed by Chief Justice KG Balakrishnan observed that the state Assembly doesn’t have power to expel Singh and others for their executive action, reports said.
Besides, the court restored Singh’s seat, which was declared vacant after his expulsion, said reports.
The apex court said that the proper remedy would set the criminal law in motion as there was no violation of privilege of the Assembly for invoking its power under Article 194(3) of the Constitution, reports said.
The bench said that the Assembly had acted erroneously as the alleged act of irregularities was committed during the 12th Assemblt whereas the act of expulsion was carried out by the 13th Assembly, said reports.
