Bill on Appointment of Judges to Be Introduced in Next Session of Parliament: Moily
Union Law Minister M Veerappa Moily has said that the Judges’ Standards and Accountability Bill seeks compiling a data bank of legal professionals so that nobody with dubious antecedent is anointed a judge in higher judiciary, said media reports.
The minister said that the bill, which a group of ministers are examining currently, would be tabled in the next session of Parliament, reports said.
Interacting with reporters at a news conference called to announced the launch of ‘a national consultation’ for the ‘Second Generation Reform in Legal Education’, Moily revealed that his ministry was working on a separate bill on the appointment process for judges, said reports.
Prime Minister Manmohan Singh and Chief Justice of India KG Balakrishnan will inaugurated the national consultation to be held May 1-2 at Vigyan Bhawan in New Delhi.
Moily said that the consultation would identify the major challenges in the field of legal education and draw a roadmap for reforms, reports said.
“India presently faces major challenges in the field of legal education to respond to global challenges,” he was quoted as saying.
“Despite having emerged as a leading global hub for the knowledge-based service industry, the country still needs a revolution to respond to global challenges in providing services particularly by lawyers,” the minister was quoted as saying.
Besides, he also highlighted the need to amend the Advocates Act, 1961, which empowers the Bar Council of India to regulate legal education in India in addition to exercising disciplinary jurisdiction over lawyers, said reports.
“At present, legal education is being imparted by 913 colleges recognised by the Bar Council of India and 14 national law universities established under various state laws,” Moily was quoted as saying.
“Though the BCI has made rules under the Advocates Act to regulate legal education, the standard of education does not meet the present day requirement of the legal profession,” Moily was quoted as saying.
