Bofors Scam: Lawyer Questions Propriety of Govt Counsels

A lawyer, who has been against the CBI’s step to drop all cases against Italian businessman Ottavio Quattrocchi, has raised a question of propriety before a Delhi court, stating that senior government law officers handling the case had defended an accused in the multi-crore scam.

Ajay Agarwal, who filed his written submissions in the court of Chief Metropolitan Magistrate Kaveri Baweja, said that Solicitor General (SG) Gopal Subramanium and Additional Solicitor General (ASG) PP Malhotra, who represent the CBI now, had defended Win Chaddha, one of the accused, before different Delhi courts.

Agarwal submitted that the propriety and professional ethics demand that these lawyers who occupy the high offices such as SG and ASG should have declined to admit the brief of Centre and the CBI in this Bofors gun deal scam case after they appeared for the accused persons.

It may be mentioned that earlier on October 9, ASG Malhotra and CBI counsel Naveen Kumar Matta put questions on locus standi of Agarwal in opposing CBI’s application to shut the case against Quattrocchi by citing that there should be no place of “publicity and politics” in the case and that the petitioner was stranger in the matter.

In his reply, Agarwal countered their plea by saying that the Supreme Court had already accepted his locus in the Bofors case by accepting appeal filed by him against a Delhi High Court verdict.
