‘Hand over Sheikh Shahjahan to CBI by 4:15 pm’: Court’s strict order to Bengal

The Calcutta High Court on Wednesday asked the West Bengal government to hand over the custody of suspended TMC leader Sheikh Shajahan to the CBI by 4:15 pm.

The order came after the CBI told the High Court that the West Bengal government should be pulled up for contempt for not handing over the custody of Shajahan in connection with the January 5 attack on Enforcement Directorate (ED) officials in Sandeshkhali.

The CBI claimed that the Bengal CID did not comply with the High Court’s Tuesday’s order to hand over Sheikh Shajahan to the probe agency.

Additional Solicitor General (ASG) SV Raju, appearing for the ED, told the court that the government did not give Shahjahan’s custody as it had moved the Supreme Court against the HC’s order.

“There is no order staying the High Court order. This is contempt of the High Court order. It cannot wait…the purpose of the order is frustrated then,” the ASG said.

The counsel appearing for CBI said the probe agency had communicated the High Court order to all officials of West Bengal. “Letters have been sent to the DGP, Chief Secretary, including Addtl DG, CID,” the CBI counsel said.

The counsel also cited a letter by the DGP saying that the matter was mentioned before the Supreme Court and asked the CBI to wait for its disposal.

“What kind of statement is this, and that too from the deputy general of police, CID,” the counsel said.

On Tuesday, the Calcutta High Court called the Bengal Police “totally biased” and ordered that the investigation into the attack on Enforcement Directorate (ED) officials at Sandeshkhali in January be transferred to the CBI.

However, the Bengal government approached the Supreme Court against the HC’s order. The police refused to hand over Sheikh’s custody to the CBI, saying the matter was sub-judice.

The West Bengal government, represented by senior advocate Abhishek Singhvi, on Wednesday sought urgent listing of its plea in the Supreme Court.
