CM Writers to PM; Described CBI’s Stand on Gas Verdict as Surprising, Unfortunate

In a letter written to Prime Minister Manmohan Singh, chief minister Shivraj Singh Chouhan has described the CBI’s opposition to Madhya Pradesh government’s appeal against June 7 verdict delivered by Chief Judicial Magistrate (CJM) Bhopal in the Bhopal Gas Disaster as quite surprising and most unfortunate, said an official release.

The Chief Minister said that it may constrain the state government to request the Government of India to entrust back all the subsequent legal proceedings to the State of Madhya Pradesh.

He also urged the Prime Minister to direct for a review of the stand taken by the CBI so that they may work with the state government to meet the ends of justice.

In his letter, Chouhan said that the masses felt that the verdict of the Court of CJM had done too little, too late in terms of delivering justice.

The Government of Madhya responded immediately by appointing a committee of eminent jurists on June 8, 2010 with a mandate to recommend appropriate legal resourse to redress the grievances of the milieu in the matter.

The committee had persons of legal eminence including former and present Advocate Generals of the State as well as a retired judge. It’s chair was entrusted to Vivek Tankha, one of the most eminent lawyers.

The committee did a commendable job by sumbiting a report within a period of nine days with a 12-point course of action. One of them pertains to filing of an appeal against the inadequacy of sentence by the State of Madhya Pradesh before the District Judge, Bhopal.

The Chief Minister said that he was informed that such recommendation was based on the provisions of the Criminal Procedure Code, which in case where the investigation is entrusted to the CBI, though, bars any appeal by the State against acquital, but expressly provides for an appeal by the State against inadequacy of sentence.

He said that such legal position has also been enunciated in the recent judgement of the Supreme Court in matter of state of Bihar v/s Lalu Prasad Yadav.

In pursuance of the recommendations, the State of Madhya Pradesh preferred an appeal before the District Judge, Bhopal for enhancement of sentence on June 28, 2010.

Chouhan said that on issuance of notices by the District Judge, Bhopal in the said appeal, the Central Bureau of Investigation (CBI) has replied to the court that the State of Madhya Pradesh does not have a necessary locus to espouse the matter.

Chouhan said that such stand of the CBI has constrained him to write this letter and take up the matter with him (Prime Minister).

He said that the Bhopal Disaster left the masses of the state in deep sorrow and caused immense loss of life and property. The aftermath of disaster has been no less saddening, and the belief of the masses in the justice delivery system has been shaken.
