Shahjahanpur: A law student in Uttar Pradesh who has accused the BJP’s Chinmayanand of rape was arrested and jailed on Wednesday in an extortion case filed by the politician. Her family alleges that the police arrived this morning – a day before a court was to take up her request for protection from arrest – and dragged her out of their home without even her slippers.
The 23-year-old, her face covered, was taken to a hospital swarming with policemen for a routine medical examination before the arrest. Her father alleges he was forced to sign an arrest “memo”, a document necessary for police paperwork.
The man she has accused of raping her, 72-year-old Chinmayanand, was arrested on Friday but is currently not in jail. He has been in hospital for apparent heart trouble since Sunday. A former union minister of state for home, he has neither been suspended nor expelled by the ruling BJP.
On Tuesday, a court in Shahjahanpur had agreed to hear the student’s request for protection from arrest on Thursday. The development coincided with reports that the police were out to arrest her on Chinmayanand’s allegation that she tried to extort him.
The woman was on her way to court when the Special Investigation Team (SIT) of the UP police dramatically stopped her car, pulled her out and forced her into their vehicle, sources said. As chaos erupted and the media arrived, the police finally allowed the woman to go to court. But she now has to apply for regular bail.
The woman alleges that Chinmayanand, who runs several ashrams and educational institutions, sexually exploited her after helping her with admission into his law college last year. He allegedly filmed her taking a bath at the hostel, blackmailed her with the video and raped her. She was allegedly brought to his room at gunpoint and was forced to give him massages, a few videos of which are already in circulation.
The case went public when the student vanished on August 24 after putting up a Facebook post without naming the politician. Chinmayanand’s team then filed an extortion case. When the UP police tracked her down after a week, the Supreme Court heard her allegations and ordered the SIT to inquire into them.
The police have based their charges against Chinmayanand on videos the woman claims she made using a camera in her spectacles. The police said he had “admitted to almost every allegation” when confronted with the videos.
The BJP leader has been charged under a law that deals with rape but a sub-section has been applied in his case, which deals with “misusing authority for sexual intercourse”. The reading of the section suggests a watered-down charge which carries a punishment of five to 10 years in jail and a fine. A direct rape charge would have meant a seven-year jail term extending to a life term. He has also been charged with stalking, criminal intimidation and wrongful confinement.
