Supreme Court end of 32-year marriage as Jammu and Kashmir Chief Minister Omar Abdullah and Payal Abdullah settle long legal fight.
Supreme Court on Friday officially approved the divorce between Jammu and Kashmir Chief Minister Omar Abdullah and his estranged wife Payal Abdullah. The top court passed the order after both parties agreed to end their 32-year-old marriage through mutual settlement.
Supreme Court Accepts Joint Petition Under Article 142
The Supreme Court bench of Justice P.S. Narasimha and Justice Alok Aradhe accepted the joint divorce request filed by the couple under Article 142 of the Constitution. Senior Advocate Kapil Sibal, representing Omar Abdullah, informed the court that both sides resolved all their personal disputes through mediation and decided to withdraw all active cases against each other.
Omar Abdullah and Payal married in September 1994 and have two sons. They first met while working at the Oberoi Hotel in Delhi. However, the couple began living separately in 2009 after differences arose.
In 2016, a family court dismissed Omar Abdullah’s divorce plea, stating he could not prove allegations of cruelty. He appealed to the Delhi High Court, which also upheld the trial court order in December 2023. Earlier, the Delhi High Court ordered him to pay Rs 1.5 lakh every month to Payal as interim maintenance and Rs 60,000 monthly for his son’s education.
Omar Abdullah then moved the Supreme Court. In August 2024, the apex court referred the matter to its mediation center to help both sides reach an agreement. Following mediation meetings, both parties submitted a joint petition on July 22 to finalize their mutual divorce.
